A large part of our practice at L.I.H. Law is dedicated to helping those who have fear of returning to their home country on account of some form of harm, threats, or persecution they faced or may face in the future. The U.S. offers a form of protection for people such as this—it is called asylum. If you are eligible for asylum you may be permitted to remain in the United States.

Read MoreIf you or your immediate relative entered the U.S. originally without a visa or your immediate relative is outside the U.S., you or they can obtain permanent resident status through “consular processing.” The U.S. citizen or permanent resident relative must first file an I-130 Petition for Alien Relative (See prior blog post). Once that petition is approved, the immediate relative will be able to apply for residency through a U.S. consulate abroad.

Read MoreA common scenario among our clients is that the client has an immediate relative (spouse, parent, child under the age of 21) who has or who can petition for them with Form I-130 (explained in a previous blog post), but the client entered the U.S. without a visa or inspection. As immigration laws exist currently, a person who has entered the U.S. without a visa or inspection cannot process their residency (green card), which would normally be done with Form I-485, while in the U.S., because they were not originally inspected and admitted (there are some exceptions). This program, known as Deferred Action for Childhood Arrivals (DACA), began on August 15, 2012. While it does not offer permanent lawful status, it does grant a two-year work permit.
